A person, other than one employed or permitted by the City and acting under the instruction and supervision of the Director or designee, who removes, alters, defaces or in any way tampers or interferes with a City benchmark, is guilty of a misdemeanor and is liable for the cost of repair or reestablishment of the benchmark.

A person who, without prior authorization and application as described in WAC 332-120, intentionally disturbs or destroys a survey monument, placed by a surveyor in the performance of the surveyor’s duties, is guilty of a gross misdemeanor and is liable for the cost of the reestablishment.

A person convicted of a violation of this chapter shall be punished as prescribed in VMC 7.00.010.M. (Ord. M-4026 §3, 2012)
