A. All newsracks in a public place shall align parallel with the curb.

B. No newsrack shall be chained, tied, or otherwise fasten or affixed to any publicly-owned fixture, including but not limited to trees, traffic control devices, signposts, utility poles, streetlights, or telephone poles.

C. Newsracks shall not be placed, installed, or maintained:

1. Within a street, traffic island, median, or traffic circle;

2. Within five (5) feet of any marked or unmarked crosswalk;

3. Within five (5) feet of a fire hydrant;

4. Where clear space for passageway of pedestrians is reduced to less than five (5) feet;

5. Where the newsrack or use of the newsrack may cause damage to lawn, flowers, shrubs, trees, or similar landscaping;

6. Within five (5) feet of any driveway, alley, truck loading zone, or curb cut;

7. Within twenty (20) feet of any ADA ramp;

8. On any grating or manhole cover;

9. Where the newsrack may cause damage to or interfere with the use of any pipes, vault areas, telephone or electrical cables and wires;

10. Where the newsrack may hinder ingress or egress to parked vehicles in marked parking stalls;

11. Where the newsrack is within a vision clearance triangle as defined by VMC 20.985.020;

12. Where the newsrack may obscure any regulatory sign;

13. Within twenty (20) feet of any area used for loading and unloading passengers at a C-TRAN, taxi, or passenger loading zone; or

14. Within sixty feet (60) of each side of multiple newsracks.
