A. A person may install a multiple newsrack, at the person’s own expense, in compliance with all of the following conditions:

1. Placement of the multiple newsrack complies with all placement requirements of this chapter.

2. The proposed multiple newsrack provides sufficient compartments for distribution of all publications being distributed on the date of installation of the multiple newsrack in freestanding newsracks within sixty feet (60') of each side of the proposed location of a multiple newsrack.

3. Nothing in this chapter authorizes a person who installs a multiple newsrack to charge a distributor for distribution of its publication from the multiple newsrack.

B. A multiple newsrack may be bolted to a sidewalk without a permit if the person installing the multiple newsrack first arranges with the Manager for its precise placement in compliance with this chapter, and upon removal restores the sidewalk surface.

C. Once a multiple newsrack has been installed, no freestanding newsrack may be placed within sixty feet (60') of each side of the multiple newsrack. If the multiple newsrack is full, a distributor who wishes to distribute its publication at that location may do so by installing, at its own expense, an additional identical multiple newsrack immediately adjacent to the existing multiple newsrack. The additional multiple newsrack must comply with all other requirements of this chapter for placement of multiple newsracks. (Ord. M-4026 §14, 2012; Ord. M-3929 §6, 2009)
