Except as provided elsewhere in the code or as approved by the City Council, no person may make any unauthorized use of the right of way within the City for other than travel and property access unless that use complies with this chapter and any administrative rule that is adopted to implement it.

Limited Exemptions. The following activities are exempt from having to obtain the approval of a traffic control plan under this chapter. Even where exempt from the requirement for a traffic control plan, exempt activities must be conducted in compliance with the minimum requirements of this chapter as contained in Section 11.40.060.

Parades, athletic events, or other small events conducted by the City.

Activities conducted by a government agency acting within the scope of its authority.

Funeral processions operated by a licensed mortuary.

Expressive activities as defined in this chapter that are conducted outside of the traveled way.

Temporary stands for the sale of refreshments by children, also known as lemonade stands.

Newsracks regulated by Section 11.40.

Minor encroachment as allowed or required under Title 20 or Title 17.

Emergency construction or repair activities where use of the right of way is necessary for that construction or repair, and only in compliance with subsection 11.90.020.B.
