a. Any person operating or riding a motorized surfboard, personal watercraft, sailboard or windsurfer must wear at all times a personal flotation device that is approved by the United States Coast Guard for that activity. Any person operating or riding any other watercraft not mentioned above, must have accessible at all times a personal flotation device that is approved by the United States Coast Guard for that activity; provided, however, this section shall not apply to a performer engaged in a professional exhibition or a person participating in a regatta, race, marine parade, tournament or exhibition authorized or otherwise permitted by the appropriate agency having jurisdiction and authority to authorize such events.

b. Except as provided for in Section 15.06.060 of this chapter, a violation of this section is a civil infraction punishable under RCW 7.84.100 if the watercraft is not carrying passengers for hire.

c. If the watercraft is carrying passengers for hire, a violation of this section is a misdemeanor punishable by a fine not to exceed one thousand dollars and/or by imprisonment not to exceed ninety days. (Ord. M-3104 §20, 1993)
