a. Every remote-operated personal watercraft shall have a flag attached which meets the requirements of RCW 88.12.080 (3) and as hereinafter amended. A violation of this subsection is an infraction under Chapter 7.84 RCW.

b. No person shall operate a personal watercraft on the waters during the period from sunset until sunrise.

c. A person operating a personal watercraft equipped by the manufacturer with a lanyard type engine cutoff switch must attach the lanyard to his or her person, clothing, or personal floatation device as is appropriate for the specific watercraft.

d. A person under the age of fourteen shall not operate a personal watercraft on the waters of the city.

e. A person shall not operate a personal watercraft in a reckless manner, including recklessly weaving through congested watercraft traffic, recklessly jumping the wake of another watercraft unreasonably or unnecessarily close to the watercraft or when visibility around the watercraft is obstructed, or recklessly swerving at the last moment to avoid collision.

f. A person shall not lease, hire, or rent a personal watercraft to a person under the age of sixteen.

g. Subsections (a) through (f) of this section shall not apply to a performer engaged in a professional exhibition or a person participating in a regatta, race, marine parade, tournament, or exhibition authorized or otherwise permitted by the appropriate agency having jurisdiction and authority to authorize such events.

h. Violations of subsections (b) through (f) of this section constitute a misdemeanor subject to a fine not to exceed one thousand dollars and/or by imprisonment not to exceed ninety days. (Ord. M-3104 §26, 1993)
