Violations of a declaration of civil emergency issued pursuant to VMC 2.12.030 or of a subsequent emergency order issued pursuant to VMC 2.12.040, or any other order or directive given by a law enforcement officer or designated emergency services personnel pursuant to authority of such declaration or orders is a misdemeanor; provided that a second or subsequent offense hereunder shall be a gross misdemeanor.
