There is created in city government a civil service commission which shall be composed of five persons. At least one commissioner appointment shall be filled by a union representative. The members of such commission shall be appointed by the mayor; provided, that the members of the civil service commission as constituted under Chapter 2.56 VMC, which was repealed by Section 2 of the ordinance codified in this chapter, shall be the initial commissioners of the newly created civil service commission. Each shall continue in office until the term of his or her previous appointment expires or until he or she is otherwise replaced. Any member may be reappointed.

The members of the commission shall serve without compensation. No person shall be appointed a member who is not a citizen of the United States, a resident of the city, and an elector of Clark County. Except for the initial commission, the term of office of such commissioners shall be six years.

Any member of the commission may be removed from office for incompetency, incompatibility or dereliction of duty, or malfeasance in office, or other good cause; provided, however, that no member of the commission shall be removed until charges have been preferred, in writing upon due notice, and a full hearing had by the city council upon request of the member.

The members of the commission shall devote due time and attention to the performance of the duties hereinafter specified and imposed upon them. Three members of the commission shall constitute a quorum. The votes of any three members concurring shall be sufficient for the decision of any matter and for the transaction of any business by the commission. (Ord. M-4291 § 1, 2020; Ord. M-2768 § 3, 1988)
