The city council shall award the contract to the lowest responsible bidder or may reject any and all bids when it finds that the public interest will be served thereby.

For contracts for public works and improvements of $300,000 or less, the director or designate shall, subject to review of any bidder protest submitted to the director or designate in conformity with RCW 39.04.105, award the contract to the lowest responsible bidder based on the criteria set forth in VMC 3.05.310 or may reject any and all bids when he/she finds that the public interest will be served thereby. The director or designate shall provide the protesting bidder with not less than two business days’ notice of the intent to award the bid to another bidder and to execute a contract. (Ord.
