All money received by the treasurer in payment of fines and costs shall be credited to the current expense fund. All bail money received by the treasurer shall be deposited in a special fund hereby created to be termed "police court bail trust fund." Disposition of money in such fund shall be made by treasurer's check only upon order of the police judge as follows:

a. Upon order of forfeiture of bail, the amount so forfeited shall be paid to the current expense fund.

b. Upon order of return of bail, the amount so ordered to be returned shall, upon surrender of the bail receipt, be paid to the person who posted such bail.

c. Upon a sentence imposing a fine and costs upon any person for whose appearance bail has been posted, the amount of such bail shall, upon surrender of the bail receipt, be credited upon such fine and costs and be paid to the current expense fund. In the event such fine and costs is less than the amount of bail posted, the city treasurer, upon surrender of the bail receipt, shall pay the fine and costs from such bail money by payment of the amount of the fine and costs to the current expense fund, and pay the remainder of such bail money to the person who posted such bail.

d. Upon a sentence of imprisonment upon any such person for whose appearance bail has been posted, the bail, or such portion of it as is properly returnable shall, upon surrender of the bail receipt and upon surrender of the sentenced person to the chief of police to serve his sentence, be paid to the person who posted such bail.

e. Upon an appeal being taken from a conviction in police court and upon order of the police judge that bail posted shall stand as an appeal bond, the amount of the bail shall, upon surrender of the bail receipt, be paid to the clerk of the superior court to which the appeal is taken.

f. In cases other than provided for above, money in such fund shall be paid out pursuant to proper order of the police judge. (Ord. C-306 §4, 1950)
