5.53.010 Definitions.
As used in this chapter, the following words and phrases shall have the following meanings unless the context clearly requires otherwise:
"Adult entertainment business" means any store, establishment, tavern, club or theater having as more than fifty percent of its stock in trade, books, magazines or other periodicals or video movies, films, photographs, live appearances or performances and which books, movies, etc. are distinguished or characterized by their emphasis on matters depicting, describing or related to "specified anatomical areas" or "specified sexual activities," as defined in this section.
"Adult movie theater" means any part of a panorama premises where films or video cassettes of specified sexual activities are shown to more than one customer at a time.
"Clerk" means the Vancouver city clerk and/or his/her employee or agent.
"Panorama" or "peep show" means any device which, by use of a coin or for other payment of a fee, or by payment of membership fee or other charge, is used to view, exhibit or display a film, videotape or videodisc. All such devices are denominated in this chapter by the terms "panorama" or "panorama device."
"Panorama premises" means any premises or portion of any premises on which any panorama device showing specified anatomical areas and/or specified sexual activities is located, and to which members of the public are admitted. The term "panorama premises" as used in this chapter does not include movie or motion picture theater auditoriums capable of seating more than twenty-five people.
"Panorama station" means the portion of any panorama premises in which a panorama device is located and where a patron or customer would ordinarily be positioned while watching the panorama device.
"Specified anatomical areas" means:
1. Less than completely and opaquely covered: human genitals, pubic region, buttock, and female breast below a point immediately above the top of the areola;
2. Human male genitals in a discernibly turgid state even if completely and opaquely covered.
"Specified sexual activities" means:
1. Human genitals in a state of sexual stimulation or arousal;
2. Acts of human masturbation, sexual intercourse or sodomy;
3. Fondling or other erotic touching of human genitals, pubic region, buttock or female breast. (Ord. M-3068 §2, 1993)
