No person other than the city’s solid waste or recyclables contractor may take from any drop box or container any material which has been left for pickup by the contractor by its customers. No person shall divert to his or her personal or commercial use or gain any material which has been left by any other person in any drop box or other container for pickup as a recyclable without the express permission of the person depositing such material or of the person owning or operating such drop box or other container. Licensees shall not pick up any recyclable materials in which solid waste as defined in Section 5.62.001 is mixed. Licensees shall only collect source-separated recyclables set in or alongside containers owned or provided by the licensee or its customers. The collection of de minimis amounts of solid waste mixed with otherwise source-separated recyclables shall not be a violation of this section. (Ord. M-3207 §8, 1995)
