Application for a closing out sale license shall be made at least five days prior to the proposed opening date of the sale, or the advertising of the sale, and shall be made to the city clerk on a form to be prepared by him which shall contain a sworn statement to be signed by the applicant stating that none of the listed goods has been brought to the store within twenty days last past and that it is intended to close such store permanently immediately after the sale. Filing of a false affidavit shall be a violation of this chapter. Such license shall be issued by the clerk upon proper execution of the application form. No license shall be issued to any person to conduct a close out sale for any business which he had not conducted for at least sixty days at the time of application. (Ord. M-2971 §1, 1991: Ord.
