A. “Aerosol paint” means any aerosol container that is adapted or made for the purpose of applying paint or pigment that is not water-soluble.

B. “Broad-tipped marker” means any indelible marker or similar implement with a flat, pointed, or angled writing surface that, at its broadest width, is greater than one-fourth of an inch, containing ink or other pigment that is not water-soluble.

C. “Etching Equipment” means any tool, device, equipment, or substance that can be used to make permanent markings on metal, glass, plastic, concrete or stone.

D. “Graffiti” means any unauthorized writing, painting, drawing, inscription, figure, design, label, mark, or other defacement that is written, marked, etched, scratched, sprayed, drawn, painted, engraved, adhered to, or otherwise affixed to any surface of public or private property, to the extent that the graffiti was not authorized in advance by the owner or occupant of the property.

E. “Graffiti implement” means an aerosol paint container or other pressurized container, broad-tipped marker, paint stick, etching equipment, brush, gum label, or any other device that is of the type capable of scarring or leaving a visible unauthorized inscription, word, figure, painting, mark or other defacement on any natural or manmade surface.

F. “Gum label” means any material such as, but not limited to, decals, stickers, posters or labels which contain a substance commonly known as adhesive or glue, which cannot be removed from the surface in an intact condition and with minimal efforts.

G. “Paint stick” or “graffiti stick” means any device containing a solid form of paint, chalk, wax, epoxy, or other similar substance that is not water-soluble and is capable of being applied to a surface by pressure and leaving a mark of at least one-fourth of an inch in width.

H. “Pressurized Container” means any can, bottle, spray device, or other mechanism designed to propel liquid which contains ink, paint, dye, or other similar substance which is expelled under pressure, either through the use of aerosol devices, pumps, or similar propulsion devices, and is capable of marking property.

I. “Unauthorized” means not expressly permitted by the owner or legal occupant of the property. (Ord. M-4084 §2, 2014)
