A. Violation of VMC 8.21.020 Section A is a gross misdemeanor, punishable by a fine not to exceed $5,000, or imprisonment not to exceed 1 year, or both such fine and imprisonment. Violation of any of the provisions of VMC 8.21.020 Section B and C is a misdemeanor, punishable by a fine not to exceed $1,000, or imprisonment not to exceed 90 days, or both such fine and imprisonment.

B. Community Service. As part of the penalties specified in this section, the court may order any violator to perform community service under the supervision of a community service provider approved by the chief of police. Reasonable effort should be made to assign the violator to a type of community service that is reasonably expected to have the most rehabilitative effect on the violator, including community service that involves graffiti removal.

C. Parental Civil Liability. In the case of a minor, the parent or guardian having custody of the juvenile shall be jointly and severally liable with the minor for the payment of all fines and/or restitution imposed as the result of a violation of this section. If the minor is convicted of defacement, the parent or guardian shall also be liable to the owner of the defaced property in a civil action at law for damages in an amount not to exceed $5,000. (Ord.
