Every person taken to the receiving center shall be immediately informed in writing that he or she has a right to call an attorney either immediately or later, and he or she may individually or through his or her attorney, demand a court hearing within forty-eight hours or earlier, which hearing shall then be conducted and the court shall determine whether the person in fact should be kept in such facility under this chapter, and shall order him or her released if the court finds the person is not incapacitated by liquor and that it is safe for him or her to be released.
