A. The Clark County public transportation benefit area authority (C-Tran) is authorized to establish bus loading zones on any city street which comprises any part of any of its transit routes; provided, in each case C-Tran staff shall submit its plans to the city department of public works and such zones shall not be established if the traffic engineer finds that the bus loading zone would create a traffic hazard or be inconsistent with standards of this chapter or with other city ordinance; provided, however, in the case of the downtown commercial area (parking zones 1, 1A, 2 and 3), and the north main commercial area from McLoughlin to Fourth Plain, the C-Tran staff shall submit plans to the parking advisory committee and city council rather than to the city department of public works. If, after receiving advice from the parking advisory committee, the traffic engineer or the city council finds that no hazard will be established and that the proposed bus zone is consistent with such standards, the traffic engineer shall so advise C-Tran and it may proceed to establish such zone and to post and thereafter to maintain appropriate signs. Such bus loading zones shall be for the exclusive use of C-Tran, or other public transportation vehicles, in picking up or dropping off of passengers. No one shall park any nontransit vehicle in any bus loading zone, except as necessary in emergency situations by fire or police vehicles or as authorized at WAC 308-330-457. Anyone parking in violation of this section shall be guilty of a traffic infraction, and any vehicle so parked may be towed away and impounded by C-Tran, subject to all other provisions of this title.

B. Such zones shall be no longer than one hundred feet and no shorter than thirty feet. Bus zones in residential zones shall be not closer than four hundred feet from any other bus zone. Bus zones shall not block any lawful access to any city street. Bus zones may be eliminated by C-Tran upon notice to the department of public works and C-Tran then shall remove all signs and markings relating to transit use. (Ord. M-3276 § 8, 1996: Ord.
