The hearing to consider any right of way vacation will be held before the City Council on the date fixed by resolution. The determination whether to grant or deny the petition will include, but will not be limited to, consideration of the following criteria:

A. Whether a change of use or vacation of the subject property will better serve the public;

B. Whether the subject property is no longer required for public use or public access;

C. Whether the substitution of a new and different public way would be more useful to the public;

D. Whether conditions may so change in the future as to provide a greater use or need than presently exists; and

E. Whether objections to the proposed vacation are made by owners of private property (exclusive of petitioners) abutting the subject property or by other governmental agencies or members of the general public.

The City Council may grant the petition to vacate the subject property by ordinance, with or without conditions, or the City Council may deny the petition. (Ord. M-4026 §5, 2012)
