The City will approve, approve with conditions, or disapprove the application as necessary to protect City infrastructure and the health, safety, and general welfare of the users of the right of way. The following review criteria will apply to the application for the permit:

a. The financial and technical ability and legal capacity of the applicant to complete the proposed construction activity;

b. The capacity of the right of way for safe accommodation of the applicant’s proposed construction activity, including the need for additional utility or telecommunications facilities;

c. The extent of damage to or disruption of any public or private facilities, improvements, services, travel, or landscaping and any plans by the applicant to mitigate or repair such damages;

d. The availability or unavailability of alternate routes or sites to those proposed by the applicant;

e. Whether the proposed construction activity interferes with any existing utilities, unless the applicant is granted written consent from the Public Works Director and the utility company or person owning the utility;

f. Compliance with traffic control and safety as required by this title and the City Traffic Engineer;

g. If the proposed construction activity is associated with improvements to or development of private property, whether that improvement or development has been permitted as required under titles 20 and 17;

h. If the right of way in which the work is proposed is subject to a 5-year street cut prohibition moratorium pursuant to 11.80.100; and

i. If the applicant has participated in a pre-construction meeting if one is required for the proposed project. (Ord. M-4026 §11, 2012)
