a. It is unlawful for any person who owns or is in control of any watercraft to authorize or knowingly permit the same to be operated by any person who by reason of physical or mental disability, incapacity, or immaturity is incapable of safely and lawfully operating such watercraft under the prevailing circumstances, including the type, size and motor power of the watercraft, and weather and water conditions.

b. A person convicted of violating this section shall be subject to a fine not to exceed one thousand dollars and/or by imprisonment not to exceed ninety days. (Ord. M-3104 §8, 1993)
