The prohibition against obstructing pedestrian or vehicular traffic in this chapter shall not apply to:

1. Acts authorized as an exercise of one’ s constitutional right to picket or legally protest;

2. Any person sitting or lying down upon a public sidewalk due to a medical emergency;

3. Any person, who, as a result of disability, utilizes a wheelchair, walker, or similar device to move about the public sidewalk;

4. Any person operating or patronizing a commercial establishment conducted on the public sidewalk pursuant to a properly issued permit;

5. Any persons participating in, or attending a parade, festival, performance, rally, demonstration, meeting, or similar event conducted on the public sidewalk pursuant to a street use or other lawfully issued permit;

6. Any person sitting on a chair or bench located upon the public sidewalk which is supplied by a public agency or by the abutting private property owner;

7. Any person sitting on a public sidewalk within a bus stop as defined by WAC 308-330-112 while waiting for public or private transportation; provided that such person is not sitting in a manner as to block passage by another person or vehicle, or so as to require another person or a driver of a vehicle to take evasive action or to avoid physical contact.
