A. Petitions Authorized. The owners of an interest in any real property abutting upon any street, alley, public place, public easement, or portion thereof who may desire to vacate the subject property may petition the City Council to make such a vacation.

B. Elements of Petition. The vacation petition must include:

1. A legal description of the property to be vacated, prepared and sealed by a professional land surveyor registered in Washington;

2. A plat map, prepared and sealed by a professional land surveyor registered in Washington, indicating the specific parcels abutting the subject property;

3. A vicinity map showing the general area of the proposed vacation; and

4. Any additional information that the Director determines is reasonably necessary for the City Council to consider the requested vacation.

C. Filing of Petition. The petition must be filed with the Director and must be signed by the owners of more than two-thirds of the property abutting the subject property.

D. Petition Fees. Every petition for the vacation of any subject property must be accompanied by a fee in an amount established by a resolution of the City to defray a portion of the administrative costs incurred in processing the petition and publishing, posting, and mailing notices. These fees will not be refunded under any circumstances.

E. Certification and Setting the Hearing. Upon receipt of the petition, the Director will determine whether the petition has been signed by the owners of more than two-thirds of the property abutting the subject property. Once the petition has been determined to be sufficient, the Director will bring it before the City Council, and the City Council by resolution will fix a time to hear and determine the petition by the Council or a committee thereof. This time will not be more than 60 days nor less than 20 days after the date of the passage of such resolution. (Ord. M-4026 §5, 2012)
