Unless a different meaning is shown to be clearly intended, the terms below shall have the following meanings as used in this chapter.

1. "Employee" means a person employed by the city; provided, the term "employee," as used herein, does not include and does not apply to any of the following:

A. Elective officers (members of the City Council);

B. The city manager and those persons who report directly to the city manager;

C. The city attorney and assistant city attorneys;

D. Department heads, as that term is used in the City Charter and in ordinances which establish the various departments;

E. Members of appointive city boards, city commissions and city committees;

F. Persons engaged under contract to provide any service to the city;

G. Volunteer personnel;

H. Persons hired from time to time to perform casual work, including but not limited to, those employed to perform seasonal work or to meet the immediate requirements of an emergency condition.

2. "City manager" means the person appointed by the City Council under City Charter Section 3.01 as the head of the administrative branch of the city government, and for purposes of this chapter shall include any persons designated by the city manager to act temporarily as city manager or designated by the city manager to perform a specific duty which would otherwise be reserved as a duty of the city manager.

3. "Department head" means a city employee who has been designated by the city manager to be the head of a department as defined by the City Charter or by an ordinance consistent with the charter.

4. "Disciplinary action" means an action such as a written reprimand, a suspension, a demotion or a discharge from employment for reasons which relates to the recipient's employment or conduct, and which has been or may be imposed on an employee by the city manager or by the city manager's designee. Verbal warnings, counseling, written statements of performance expectations, including related notes, and performance appraisals shall not be considered disciplinary actions, although any of these may be considered subsequently in determining whether to take any disciplinary action and in determining the type and extent of disciplinary action to be taken.

5. "Personnel policies" means those policies, guidelines and procedures adopted by the city manager pursuant to Section 2.45.040 of this chapter. (Ord. M-2850 §4, 1989)
